If the person has a limited liability policy or has chosen not to pay for insurance coverage at all, you will likely need to look to your own insurance to see if you have underinsured or uninsured coverage. In cases where the injuries support a recovery in excess of the available insurance coverage, it may be necessary to look into the at-fault party’s own assets.
Where your injury was serious enough that an ambulance transported you to the hospital, then there will be a record of the incident. If you have a legitimate injury but the circumstances did not require an ambulance, go to your primary physician for medical attention as quickly as you can be seen.
If you don’t have a primary physician, or insurance, find some other way to get medical assistance. Past experience has shown that those who don’t seek medical attention at the time of the accident or soon afterward, are viewed by the insurance companies as seeking a way to profit rather than seeking needed treatment and just compensation.

I know that taking time off work and seeing a doctor can be a challenge. Many people think that if they just take some ibuprofen, use an ice pack or a heating pad and rest a couple days they will be fine. If you truly believe you are injured, don't try to tough it out. Seek medical attention. It is not uncommon for people to be so distracted by their concerns about property damage, insurance issues and explaining to unsympathetic friends or family how they wrecked the car, that they don't realize they've been injured immediately. Some important factors to consider are being able to show the other party was at fault (police reports and or witnesses), the seriousness of the injury (medical records and bills), length of time to recover, and lost wages.
